In our conversations with public-sector leaders across the world, we hear real urgency—and a fair amount of anxiety—about the need to transform government services. At the national, state, and city levels, governments know they must find new ways to meet the expectations of citizens, many of whom are increasingly discontented. Often governments must also provide “more for less” in an environment of fiscal constraint, and myriad forces that trigger government transformations make their task more challenging.  

What distinguishes the 20 percent of transformations that succeed from the 80 percent that do not? Our study distilled five essential disciplines, “the five Cs,” and found that transformations that apply to all of them are more than three times as likely as other change initiatives to succeed. The disciplines are as follows: committed leadership, clear purpose and priorities, cadence and coordination in delivery, compelling communication, and capability for change.  

These might seem obvious, but they are rarely applied effectively—and they are particularly difficult to implement in the context of the political cycles, complex delivery systems, and multiple stakeholders that characterize the justice sector. 


#### Committed leadership  
The experience of the transformation leaders we interviewed made it clear that a high degree of personal commitment and energy—and often true courage to challenge established conventions—are necessary in bringing the five Cs to life.  
Leaders of successful transformations were twice as likely as their peers in unsuccessful initiatives to model the behaviour they expected of public servants.  


#### Clear purpose and priorities  
Successful transformations paint a compelling picture of their destination—and make it crystal clear to public servants and citizens why the change is necessary. When it comes to objectives, less is more: successful efforts keep targets few, specific, and outcome based.  


#### Cadence and coordination in delivery  
Successful transformation efforts are characterized by smart approaches to delivery, which differ markedly from traditional public-sector approaches to policy development and implementation. A smart approach requires a fast yet steady pace, a flatter hierarchy with close collaboration among different agencies and functions, and the flexibility to solve problems as they arise. It also requires an empowered and focused transformation team to spur the pace and track progress.   


#### Compelling communication  
Every government communicates, but only a few do so effectively enough to win hearts and minds. Engaging more with frontline employees such as: Judges, Court Clerks, Judicial Assistants, Courtroom Reporters, and Interpreters would have enhanced success. Transformations need well-planned, in-depth, genuine two-way communication with all the groups affected by the change—especially the organizations’ own staff. 


#### Capability for change  
Finally, governments, courts and justice agencies need to rethink their approach to public-service capabilities if they are to increase their odds of success in major change programs. Over centuries, governments have honed their skills in areas such as policy and diplomacy. They now need to build new capacity and encourage agility to transform how they deliver services. 


#### Beyond the five Cs: Putting citizens at the heart of transformations  
The task of transforming large-scale public-sector organizations is daunting—all the more so given the high failure rate revealed in our survey. By embedding the five Cs, public-sector leaders can substantially improve their odds of success (Exhibit 3). However, our study also identified further technology-inspired techniques to support faster and better change: citizen experience, design thinking, and agile practices. Pioneering organizations are using the concept of citizen experience to understand people’s end-to-end journeys in services such as public transport and business licensing. They are drawing on design thinking to reconfigure such services in a way that integrates the needs of people, the possibilities of technology, and the requirements of the provider organization. And they are deploying agile practices to quickly design, prototype, and test services with users.

Elements of a Successful Judicial Transformation 

Some courts, tribunal hearings case or hearings will attract heightened media interest because, they involve a high-profile party or subject. Often this will lead to journalists seeking to attend to observe the case or hearing itself. You should notify MoJ and Judicial press offices of all high-profile trials/hearings with heightened media interest. 


#### Publish Public Notices and Operational Media Notes 
In the case of a public hearing that will be broadcasted online, it is the responsibility of the court to produce tickets. The ticket should include the name of the trial/hearing and the organisation that it has been issued to – not the individual representing that organisation. This means the organisation can use the same ticket throughout the trial/hearing, even if the journalist covering it changes. 


#### Authenticate & Register Attendees 
Courts who regularly issue tickets for high-profile cases should consider a registration system for each trial/hearing to avoid authenticity issues. A different PIN (personal identification number) should be used for each trial/hearing, making sure local staff and security are admitted and placed correctly. 


#### Enable Remote Live Streaming for Authorized/Registered Audience 
While every reasonable effort should be made to accommodate as many members of the media as possible, sometimes this won’t be possible in a particular setting when high-profile cases are heard. If staff have reason to believe that demand for press seats will go beyond what a court room can accommodate, they should notify press offices who will issue an operational media note and provide access online to monitor courtroom proceedings online through a non-shareable interface for authorized or registered media attendees. 

Here are some steps: 

-Link to the designated Digital Courtroom 

-Link to the online test for the media representatives to test their connection 

-Details of any timing elements imposed upon the remote observations 

-Announce a “cut-off” time for joining the Digital Courtroom to reduce any potential disruption to proceedings 

-Publish the court rules for remote hearings – which are included in the Digital Courtroom guidance documents (available on the intranet)

-Disable chat, microphone, and camera access for certain users in the Digital Courtroom for larger broadcasts   


#### Monitor Attendance and Track who’s participating in your Courtroom 
The media are entitled to a form of representation during the visit, but their attendance needs to be carefully managed. When the jury, judge and parties come together to review online controls prior to the hearing, the court is effectively in session just as it would be in the court/hearing room. Real-time presence reports can be viewed to track who’s present, and attendance logs of the parties involved in the case hearing. 


#### Protocols & Managing the Digital Courtroom 
All the normal contempt rules should apply in a Digital Courtroom – the group cannot be filmed or photographed while the court is in session and evidence must not be interfered with, but equally the media should be allowed to attend. Some media photography at the site can be arranged when the court is not in session by prior request to the court staff.   


#### Elevated Controls for Court Staff & Government Agencies 
The local police should be approached well in advance of the jury site visit to discuss he type of assistance they can give in controlling the media attendance online. Experienced senior staff from the court where the trial/hearing is being held should also attend online to perform the same admin role they would in a normal court to manage the media’s attendance.

Managing high-profile cases remotely 

Changes are ensuing in justice systems at an unprecedented speed in order to adapt to the new reality of today's digitally connected world. The result is that judicial authorities (conciliation and arbitration authorities, justices of the peace, public prosecutors’ offices, the courts) are embracing change to increase their efficiency, modernize their operations and provide easier, multi-channel access to justice.  

Over the past several decades, growing case volumes and costs, coupled with tightening resource constraints, have prompted courts to seek out cost-saving and efficiency-enhancing technologies that facilitate the administration of justice. With spending cuts continuing to hit court systems globally, sales of court real estate are trending upwards. The tendency to optimize costs by maintaining a smaller number of central hubs with more courtrooms, necessarily implies greater travel and logistics costs for court staff, judges, police and other agencies, and parties.

Courts across the globe are adapting to a hybrid approach to provide better access to justice. Changes are ensuing in justice systems at an unprecedented speed in order to adapt to the new reality of today's digitally connected world. 

The big shift in the world of courts

Technology has enabled remote participation in hearings, substantially transforming the way in which proceedings are being conducted. On-site hearings are categorized as synchronous, as all participants are physically present. Proceedings that incorporate technology, however, can offer more agility, with participants conducting presentations by a judge or a member of the court’s staff. These presentations can be time-constrained, recorded, and assembled into a record for judicial or public review. A judge could conduct a shorter, synchronous proceeding after reviewing the presentations to ask questions or make a ruling based on the submitted presentations. Such asynchronous proceedings allow courts to address backlogs of proceedings suited for presentations, making the best use of scarce time on judges’ calendars. Furthermore, the use of recorded presentations can aid self-represented litigants who battle to articulate their arguments, thereby offering a more effective submission for decision.  


#### DIGITAL PROCEEDINGS   
Most court systems are paper based, implying a high paper production and transportation rate.  Judicial systems in the United Kingdom, for example, generate roughly one million pages per day for documentation, prior to the transition to a digital justice platform. Justice systems worldwide are under increasing pressure as legal complexity rises and more people rightfully demand access to justice. Digital transformation is the key for courts to keep pace. Digital justice is an immense chance to improve the lives of millions of people, but only if the technology is understood and implemented fast. 
 

The administration of justice is a core function of modern societies. Yet it is also an enormous, resource-intensive task operating in a complex, multilayered system shaped by societal conflicts, fundamental rights, and organizational challenges. Globally, justice systems exist at very different levels of maturity: According to the World Justice Project, nearly a quarter of a billion people live in conditions of extreme injustice such as slavery, lacking all fundamental rights. Another 1.5 billion people cannot obtain justice to resolve everyday legal issues, and an astonishing 4.5 billion people lack the legal tools to protect their assets or are incapable of accessing the public services to which they have a right. While some of these challenges are linked to poverty and lack of institutions, insufficient access to justice persists in some of the richest, most developed countries. Remedies are often available in theory, but the complexity, costs, and duration of legal proceedings discourage their pursuit in practice.  
 

Many factors often simultaneously influence the availability and administration of justice, but one is at the center: legal complexity. It results from an increasingly globalized economy in which products and services blend physical, augmented, and virtual realities. The rules required to organize this multidimensional global marketplace form a constantly growing, ever more complex, and interlinked regulatory ecosystem. Courts—as the primary institutions to interpret these rules and resolve resulting conflicts—not only have to navigate increasingly complicated laws but also deal with an explosion of case numbers in certain areas. Often understaffed and ill-equipped with complexity management tools from the past (e.g., paper records or fax machines), they take longer to decide cases, require costly outside expertise, or reach results that are unexpected by the parties involved. 
 

High costs, the lengthy time required to resolve cases, and uncertainty regarding outcomes, affect individuals and companies alike. As a result, individuals often display rational ignorance—failing to understand that a particular problem has a legal solution—or rational indifference—not pursuing valid legal claims because it seems like too much hassle. Consumer-facing legal technology companies have helped millions of people worldwide overcome these hurdles, understand their rights, and pursue their claims in courts. 
 

Yet when legal proceedings leave the sphere of the consumer or the company and enter the courts, they are often thrown back in time: While collaboration software and chatbots enable near real-time communication and decisions, inquiries from judges and minor procedural orders can take months to resolve.  
 

Processes that could be instantly tracked on department-wide dashboards turn into opaque proceedings with irregular updates provided only upon request. Documents that could take minutes to create at negligible cost led to perennial lawsuits that cost tens and hundreds of thousands to decide. Why is the experience so different between legal services in the private sector and public dispute resolution in courts? 
 

Insufficient digitalization leads to a bad user experience and eroding trust in our legal institutions. It drives parties into private dispute resolution and is increasingly seen as a negative location factor, inhibiting business activity and economic growth. It risks overwhelming judges and clerks. Justice systems, intended to satisfy both those seeking and administering justice, instead leaving each group dissatisfied.

The need for Digital Justice & Courtroom Modernization 

Social distancing and community shutdowns are having a deep impact on our nation’s juvenile courts. As a result, many courts have moved to “remote” hearings to handle cases. Depending on the jurisdiction, remote hearings may be via video or may only be telephonic. Some jurisdictions are holding remote hearings only for critical matters affecting youth liberty, such as detention and parole hearings. Other juvenile courts are handling all kinds of hearings remotely. 


In efforts to reduce the spread of the virus, governments issued guidance on public interactions that included stay at home orders and closing of many types of businesses. Child welfare court hearings, which have long occurred primarily in person at court houses, had to make changes to practice to ensure safety of professionals and clients alike. Responses to the pandemic varied, including delaying court hearings, moving court hearings to hybrid in-person/virtual formats, and moving to a completely virtual hearing process. Depending on the jurisdiction, remote hearings may be via video or may only be telephonic. Some jurisdictions are holding remote hearings only for critical matters affecting youth liberty, such as detention and parole hearings. Other juvenile courts are handling all kinds of hearings remotely. The boost in court appearances that followed the shift to virtual hearings is consistent with pre-pandemic assertions that reducing the day-to-day costs of coming to court—such as transportation, child care, lost wages, and travel time—would increase people’s ability to meaningfully engage in court cases. We created this checklist of strategies for courts to enable parents and youths to effectively participate in virtual hearings.  


#### **Successful strategies to get parents to attend the hearing** 


**Reminders** - Calling or emailing parents to remind them about a hearing. Some noted the day before, others the morning of the hearing.   


Preparation - Call to inform parents of the virtual process. Explain it to them step by step. Coach them through the process. Let parents know what to expect about the child welfare hearing process (virtual or in-person). Describe the platform and settings prior to the hearing.   


**Practice** - Setup a time to practice on the platform with the parent so that they can experience it prior to the event and troubleshoot any challenges.   


**Contact day of** - Get a phone number for the parent so if they do not show up, the attorney or the court can call them at the time of the hearing.   


**Flexibility** - Allow both phone and video appearances for parents.   


**Stress importance** - Describe the importance of still being present even in a virtual setting.   


**Documentation/guidance** - Create a PDF guide to share on how to access virtual platform.   


**Meet and participate** - Have parents meet with attorneys (or caseworkers) and attend the hearing virtually with them.   


**Invites** - Invitations to the court hearing can include information on how to participate and also court rules).   


**Time certain calendaring** - Set the hearing at a specific time.

#### **Strategies to engage parents in hearings**  


**Introductions** - Introduce all participants and explain their role. Introduce the virtual platform, including how to use it and participate in the proceedings. Explain expectations (e.g., when they get to talk, why they will be muted when it is not their turn, etc.).   


**Explain purpose** - Explain to parents the purpose of the child welfare hearing, why they are there and what will happen today.   


**Greetings** - Greet parents by name. Speak directly to them.   


**Opportunity to be heard** - Provide parents an opportunity to be heard. Encourage open discussion in hearings.   


**Checking-in** - Periodically ask if parents have any questions, need a break, or need to speak to their attorney.   


**Camera use** - Encourage to turn on camera so they feel more like they are part of their hearing.   


**Acknowledge hardship** - Acknowledge that virtual may be hard but it is important for them to participate.   


**Simplify** - Use simplified language whenever possible.   


**Encourage** - All professionals can encourage parent’s participation.    


**Successful strategies to get youth to attend the hearing**   


**Communication** - Speak to foster parents, caregivers, child welfare case workers and child advocates to ensure that children and youths who want to be present at a hearing have what they need to do so. Get the link out to the child’s caregiver well in advance of the hearing.   


**Stress importance** - Stress the importance of youth attending the hearing, even virtually. Emphasize that the judge is interested in hearing what they have to say. Advise youth of the value of attendance – that it will assist in achieving their goals.   


**Reminders** - Check in with the youth beforehand to provide a reminder about the hearing. Call ahead of time and remind the youth, foster parent/caregiver about the hearing. Send reminders (via phone, text or email) the day before or the morning of the hearing (or both). Make sure the youth and/or their caregivers have complete access information and re-send that information on the day of the hearing.   


**Preparation** - Explain the purpose of the hearing, what to expect in the hearing, and how the virtual hearing format will work. Provide a step-by-step description of the hearing process, who will be present and what their roles are in the hearing. Go through a list of possible questions that the youth might want to ask (to help them prepare) or the things they might want to share during the hearing. Ask if they have any concerns about the hearing so that the youth can be put at ease.   


**Practice** - Setup a time to practice on the platform with the youth so they can experience it prior to the hearing and troubleshoot any challenges. Coach the youth in the virtual hearing format by doing a test run to get comfortable with the platform, log on procedure, use of breakout rooms and chat features.   


**Flexibility** - Give youth the choice of phone or video conference. Allow the youth to join via phone only if they want. Allow the use of cell phones (e.g., FaceTime) along with computers. Set the hearing at times that facilitate youth attendance (e.g., work around school schedules).   


**Meet and participate** - Have a trusted adult available to attend the hearing virtually with the child/youth.   


**Provide channel for real-time communication** - Have another channel (i.e., text) to communicate with the child in real time during the virtual hearing if needed. 


#### **Strategies to engage youth in hearings**

**Helping children and youth feel comfortable** - Get the youth involved by asking them about school or what they enjoy doing. Use the video view of their environment to talk about what they are doing, any pets or other things around them to make them feel more comfortable. Ask young children an ice-breaker question such as “what is your favorite animal,” and then ask everyone to share what their favorite animal is, as a means to help children to be as comfortable as possible before the hearing begins. Talk about positive achievements.  


**Hear from children/youth first** - Hear from children and youth first (especially young children) when you have their full attention. Hearing from youth at the beginning of the hearing also affords an option for them to exit if there are concerns the hearing might expose the youth to derogatory or negative comments made by parents or relatives.   


**Opportunity to be heard** - Set aside time for private conversations with child and counselor on the line at the beginning of the hearing or at the end. Allow the youth to have their own time to speak and ensure that everyone mutes their mics so youth can have their voices heard without interruption.   


**Camera use** - Ensure children can stay out of sight of the camera if necessary. Allow youth to stop sharing video and participate by phone only if needed. To assist with distraction when the judge is speaking to a child, require all other participants to turn off their cameras unless allowed by the court to speak.

#### Drivers of Digital Justice  
Globally, the digitalization of justice systems is just beginning and generally lagging behind the digital transformation of the rest of society. This has led to a widening gap between the expected user experience, for both consumers and businesses, and the actual services provided by the courts.  


#### Status quo of Digital Justice Transformation  
The current state of digital justice can be understood using an adapted version of the three-layer framework that was previously developed for private legal technology: it differentiates between enabler, process support, and substantial law solutions. Compared to other parts of the legal system, courts and public offices are several years behind in technology adoption. Despite recent incentives to innovate during the COVID-19 pandemic, even economically strong countries risk missing the boat when it comes to future readiness. Insufficient hardware and software infrastructure, budget issues, a hindering mindset, and fear of personal disadvantages among stakeholders are all to blame.
